German Self-Defence Law

On my Facebook page today I have been sharing various links, quotes and extracts relating to self-defence law. It’s mainly UK stuff, but there is some Canadian, Australian and US stuff thrown into the mix. Thanks to Bernd Alscher – who emailed me this text earlier today – I also have some German stuff too!

The original text in German follows; which is obviously perfect for our German members. For those who are monolingual (i.e. our British and American members :-) I also ran the text through Google Translate in order to get rough (very rough!) English language approximation.

Rechtliche Grundlagen der Selbstverteidigung

StGB § 32 Notwehr

(1) Wer eine Tat begeht, die durch Notwehr geboten ist, handelt nicht rechtswidrig.(2) Notwehr ist die Verteidigung, die erforderlich ist, um einen gegenwärtigen rechtswidrigen Angriff von sich selbst oder einem anderen abzuwenden.

StGB § 33 Überschreitung der Notwehr

Überschreitet der Täter die Grenzen der Notwehr aus Verwirrung, Furcht oder Schrecken, so wird er nicht bestraft.

StGB § 34 Rechtfertigender Notstand

Wer in einer gegenwärtigen, nicht anders abwendbaren Gefahr für Leben, Leib, Freiheit, Ehre, Eigentum oder ein anderes Rechtsgut eine Tat begeht, um die Gefahr von sich oder einem anderen abzuwenden, handelt nicht rechtswidrig, wenn bei Abwägung der widerstreitenden Interessen, namentlich der betroffenen Rechtsgüter und des Grades der ihnen drohenden Gefahren, das geschützte Interesse das beeinträchtigte wesentlich überwiegt. Dies gilt jedoch nur, soweit die Tat ein angemessenes Mittel ist, die Gefahr abzuwenden.

StGB § 35 Entschuldigender Notstand

(1) Wer in einer gegenwärtigen, nicht anders abwendbaren Gefahr für Leben, Leib oder Freiheit eine rechtswidrige Tat begeht, um die Gefahr von sich, einem Angehörigen oder einer anderen ihm nahestehenden Person abzuwenden, handelt ohne Schuld. Dies gilt nicht, soweit dem Täter nach den Umständen, namentlich weil er die Gefahr selbst verursacht hat oder weil er in einem besonderen Rechtsverhältnis stand, zugemutet werden konnte, die Gefahr hinzunehmen; jedoch kann die Strafe nach §49 Abs.1 gemildert werden, wenn der Täter nicht mit Rücksicht auf ein besonderes Rechtsverhältnis die Gefahr hinzunehmen hatte.

(2) Nimmt der Täter bei Begehung der Tat irrige Umstände an, welche ihn nach Abs.1 entschuldigen würden, so wird er nur dann bestraft, wenn er den Irrtum vermeiden konnte. Die Strafe ist nach §49 Abs.1 zu mildern.

BGB §227 Notwehr

(1) Eine durch Notwehr gebotene Handlung, ist nicht widerrechtlich.

(2) Notwehr ist diejenige Verteidigung, welche erforderlich ist, um einen gegenwärtigen rechtswidrigen Angriff von sich oder einem anderen abzuwenden.

 BGB §228 Notstand

Wer eine fremde Sache beschädigt oder zerstört, um eine durch sie drohende Gefahr von sich oder einem anderen abzuwenden, handelt nicht widerrechtlich, wenn die Beschädigung oder die Zerstörung zur Abwendung der Gefahr erforderlich ist und der Schaden nicht außer Verhältnis zu der Gefahr steht. Hat der Handelnde die Gefahr verschuldet, so ist er zum Schadensersatze verpflichtet.

StGB § 323c Unterlassene Hilfeleistung

Wer bei Unglücksfällen oder gemeiner Gefahr oder Not nicht Hilfe leistet, obwohl dies erforderlich und ihm den Umständen nach zuzumuten, insbesondere ohne erhebliche eigene Gefahr und ohne Verletzung anderer wichtiger Pflichten möglich ist, wird mit Freiheitsstrafe bis zu einem Jahr oder mit Geldstrafe bestraft.

Zusammenfassend kann man sagen:

Kann man in einer gefährlichen Situation folgende Frage mit ja beantworten darf man sich auch verteidigen:

Sehe ich für mich eine Gefahr, die ich nicht anders abwenden kann, als durch die Verletzung des Angreifers?

Falls man sich selbst diese Frage mit ja beantworten kann hat man das Recht sich zu verteidigen. Das bedeutet aber, dass man auch immer das Mittel zur Verteidigung wählen muss, mit dem man sich sicher ist den Angriff abzuwehren, aber das den Angreifer am wenigsten verletzt.
